乙方(学院):

为了确保提前(预)就业学生(以下简称学生)的人身安全及其他合法权益,明确双方对提前(预)就业学生的安全和相关职责,做好提前(预)就业学生的安全及管理工作,现按照双方意愿,根据《安全生产法》以及《中华人民共和国劳动保护法》等有关规定,经双方协商,特签订本协议。

一、甲方职责

1、对提前(预)就业的学生进行安全教育、安全培训。

2、向提前(预)就业学生提供必要的劳动防护用品。

3、不得安排提前(预)就业学生从事各种危险作业。

4、对提前(预)就业学生在甲方工作时间、生产劳动过程中发生的人身伤害等事故,及时组织救护,发生的相关责任,学校不再负责承担。

5、妥善安排和保证学生按时完成实习任务,并按乙方规定的时间安排提前(预)就业学生按时回校参加毕业前各项相关活动。

6、与提前(预)就业学生签订协议,并根据协议发放劳动报酬。

二、乙方职责

1、做好提前(预)就业学生的教育指导工作。

2、确定毕业实习、论文指导教师,负责学生毕业相关工作的指导与联系。

3、积极配合甲方做好提前(预)就业的学生的思想政治、遵章守纪的教育工作。

未尽事宜,按国家《劳动合同法》规定执行。

本协议一式二份,甲乙双方各执一份,签章后生效。

6、遵守和企业的就业约定,积极完成企业分配的工作任务,接受企业人员的指导,不准和企业人员发生争执。

上述各项规定,提前(预)就业的学生应该严格遵守,如有违反,造成个人损失、人身伤害事故或触犯法律法规等,责任由本人自负。

二、乙方职责

1、确定毕业实习、论文指导教师,负责学生毕业相关工作的指导与联系。

2、负责就业学生的教育指导工作。

3、积极配合企业做好提前(预)就业的学生的思想政治、遵章守纪的教育工作。

未尽事宜,按国家《劳动合同法》规定执行。

本协议一式二份,甲乙双方各执一份,签章后生效。

普汇(北京)国际教育文化交流有限公司与

,就铁路行业(高铁∕动车餐吧乘务员、高铁∕动车车厢乘务员、Z∕T∕K列车乘务员、客运员、乘务安全员等)相关岗位培训培养后,定向实习就业事宜达成共识,签定本协议。普汇(北京)国际教育文化交流有限公司承诺对培训考核合格并综合考评达标,符合上岗要求的学员根据自身条件及考核考评成绩安置在以上铁路行业岗位就业,并服从分配。现与学员本人协议如下: 甲方:普汇(北京)国际教育文化交流有限公司 乙方:

一、甲方的责任和义务: 1、2-3个月内(如遇国家法定节假日时间顺延)将理论培训与实训考核合格及综合考评达标的乙方安置在铁路行业从事高铁∕动车餐吧乘务员、高铁∕动车车厢乘务员、Z∕T∕K列车乘务员、客运员、乘务安全员等铁路相关岗位工作。面向全国分配(以乙方户籍所在地或生活所在地为参考),具体工资待遇、福利、工作时间等以所在岗位实际标准为准。

2、根据行业用工规律,用工单位收取的服装押金、体检费等均由乙方自行承担。

3、甲方负责推荐乙方到铁路行业进行实习就业工作,乙方须接受实习就业所在单位的管理及安排并服从该单位安排的实习就业工作地点及工作内容,如乙方不服从甲方推荐的实习就业单位、工作地点及工作内容,不能及时上岗实习就业者,视为乙方自愿放弃甲方安置其就业的责任和义务,本协议自动终止。

4、乙方进入用人单位实习与就业,甲方负责协调双方的关系。

5、乙方在实习期间由实习所在单位承担意外伤害保险费用,进入就业岗位由就业单位按国家及本单位规定、签订合同(派遣外包合同),承担社会保险职责。

6、甲方对乙方在实习过程中给予鉴定和评语。

7、凡准确反映乙方学习、生活以及工作情况的音像、文字、照片等资料,甲方有权在本专业招生宣传或媒体报道以及上级对我专业教学状况评估检查等方面进行使用。乙方应对此表示理解和支持,并保证在使用后不提任何异议与要求。

二、乙方的责任和义务:

1、乙方如数缴纳甲方岗前培训费、教材费、住宿费、服装费等,乙方须携带身份证明、学历证明和生活学习自用品。

2、乙方在培训期间,甲方按本协议约定的就业岗位及分配方向安排乙方面试,如乙方放弃或不参加面试则延期一个月安置就业,累计两次者将自动解除本协议,费用不退,后果自负;如已面试合格,乙方擅自放弃或拒绝到用工单位报到,甲方将不再为乙方安置就业,本协议自动解除,费用不退,责任自负。

3、乙方在参加培训期间,如有各种违规违纪行为累计三次以上(含三次)(如旷课、擅自离校、夜不归宿、抽烟、违规使用电器、打架斗殴、不出早操、不服从管理人员管理等),甲方将延期安排其就业;如有各种违规违纪行为累计五次以上(含五次),甲方将不予安排其就业,此就业协议自动解除,费用不退,责任自负。

4、乙方进入实习就业岗位,要服从实习单位的统一领导,遵章守纪,不得擅自离岗返回原籍,否则责任自负。

5、乙方在实习就业时遇到工作、生活不适应要及时与实习就业单位和甲方沟通,共同解决,不可自作主张。正式上岗后与就业单位互相协商,互相配合解决,否则责任自负。

6、乙方在进入铁路相关岗位实习与就业前,需通过培训技能考核和综合素质考评。并考取行业专业证书,费用自理。

7、乙方经用人单位录取,甲方即完成了本协议中的推荐就业工作,本协议自动终止。乙方进入就业岗位后应遵守按就业单位规定签订的劳动合同或协议。

8、乙方在培训期间要严格遵守甲方制定的规章制度,接受甲方的统一管理(统一培训、统一食宿、统一服装等,培训期间食宿费和服装费自理)。如有违规违纪造成的一切后果(包括人身安全事故或违法行为),乙方负全部责任,与甲方无关。

三、其他:

1、参加培训手续办完,就业协议签过,中途放弃者或退出者不退费,乙方保证不向甲 方索要及主张。非个人原因,甲方不能安排到岗,退还培训费。

2、乙方实习就业时如用人单位需交各项服装费、内训费或押金等(具体数额以用人单位公布为准),学员自行承担。

3、甲、乙双方不得违约,本协议一式两份,具有同等效力。盖章签字后生效。

4、如有不可抗拒因素影响本协议的执行,双方协商解决。

5、未尽事宜,由双方协商解决。

6、本协议有效期自_____年___月___日至_____年___月___日生效。

7、乙方声明,本人完全具备独立签订本协议的民事主体资格,本人已经全面理解本协议的全部内容,自愿履行相应的义务及承担相应的法律后果。

协议如下:

第一条 求职者经乙方推荐到______________公司应聘,一经录用,不得借故以任何理由拒绝报到,报到后,一切与乙方无任何关系,即 终止执行协议。
